ABSTRACT
Public procurement remains a critical mechanism through which governments deliver infrastructure, goods, and services to citizens. In Nigeria, however, the tendering and contract award process has long been undermined by inefficiencies, weak institutional enforcement, and corruption. Legal assessment, particularly through regulatory frameworks and oversight bodies such as ministerial tender boards, is designed to promote transparency, accountability, and value for money in public contracting. Despite these provisions, persistent challenges such as political interference, information asymmetry, and weak compliance mechanisms continue to affect project outcomes, leading to abandoned projects, cost overruns, and substandard delivery.
This study critically examines the role of legal assessment in the tendering of contracts in Nigeria, focusing on its effectiveness in ensuring due process, fairness, and project performance. The research adopts a contemporary analytical perspective by exploring institutional weaknesses, governance gaps, and emerging reforms in public procurement. The findings are expected to contribute to policy recommendations aimed at strengthening legal frameworks and enhancing transparency in Nigeria’s contract tendering system.

INTRODUCTION
1.1 Background to the Study
Public procurement constitutes a significant component of government expenditure and plays a pivotal role in national development. It encompasses the processes through which public institutions acquire goods, works, and services, often through competitive bidding mechanisms. In Nigeria, the tendering of contracts is guided by statutory frameworks designed to ensure fairness, transparency, and accountability. Central to this process is legal assessment, which involves the evaluation of contractual compliance with established laws, regulations, and procurement standards prior to award and execution.
Despite Nigeria’s vast economic potential, the country continues to face persistent development challenges, including widespread poverty, infrastructural deficits, and inefficient public service delivery. A critical factor contributing to these challenges is the mismanagement of public procurement systems. Empirical evidence suggests that weaknesses in legal and institutional frameworks governing contract tendering have facilitated corrupt practices, including bid manipulation, favoritism, and lack of due diligence in contractor selection.

Furthermore, political interference and institutional weaknesses have been identified as major constraints to the proper functioning of legal assessment processes.
In recent years, reforms such as the Public Procurement Act and the establishment of oversight institutions have sought to address these deficiencies. Nevertheless, the persistence of procurement-related inefficiencies indicates the need for a more critical evaluation of the role and impact of legal assessment in contract tendering. This study, therefore, provides a comprehensive analysis of how legal assessment influences the integrity, efficiency, and outcomes of public procurement in Nigeria.
1.2 Statement of the Problem
The integrity of Nigeria’s public procurement system has been significantly undermined by systemic challenges, particularly in the tendering and contract award processes. Although legal assessment is a mandatory requirement designed to ensure compliance with procurement laws and standards, its practical implementation has not yielded the desired outcomes.
Incidences of contract inflation, project abandonment, substandard execution, and misallocation of public resources continue to be prevalent. These challenges suggest that existing legal assessment mechanisms are either inadequately enforced or compromised by external influences such as political interference, nepotism, and corruption.
Moreover, the lack of transparency in procurement procedures, coupled with insufficient dissemination of tender information, creates an uneven playing field for prospective contractors. This often results in the selection of contractors based on non-merit factors, thereby undermining the principles of fairness and competitiveness.
Given these persistent issues, there is a critical need to examine the effectiveness of legal assessment in Nigeria’s contract tendering system. This study seeks to identify the gaps within the current framework and evaluate how these shortcomings impact project delivery and overall public sector performance.
1.3 Objectives of the Study
The primary objective of this study is to critically assess the role of legal assessment in the tendering of contracts in Nigeria. The specific objectives are to:

For contractors and private sector stakeholders, the study offers a clearer understanding of the procurement environment and the factors influencing contract awards.
Academically, this research contributes to the growing body of literature on public procurement, governance, and institutional reforms in developing economies. It also serves as a valuable reference for future researchers interested in procurement systems and legal frameworks.
1.7 Scope of the Study
This study focuses on the role of legal assessment in the tendering of public contracts in Nigeria. It examines institutional frameworks, regulatory mechanisms, and the operational performance of procurement bodies, with particular emphasis on ministerial tender boards.

1.8 Limitations of the Study
